The Malta Financial Services Authority (MFSA) has published a revised version of its Frequently Asked Questions document concerning the Loan Fund Rules which was originally issued on 22 May 2015.
The revised FAQ provides an update on the type of loans which may be originated by loan funds as well as on the type of loan portfolios which may be acquired by loan funds.
The revised question is: What types of loans may be originated by Loan Funds?
Answer: These types of Schemes may issue loans solely and exclusively to unlisted companies and SMEs. Financial undertakings as defined in the Rules shall however not be eligible to receive financing from these Schemes.
The Loan Fund Rules further specify that a Collective Investment Scheme may not originate loans to households or individuals. However, loans to households or individuals that have been originated by credit institutions may be acquired by a Loan Fund under the applicable conditions established by the Loan Fund Rules.
