In response to a query concerning the format of notification to avail of the Malta market making and authorised primary dealer exemptions under Article 17(5) of the EU Short Selling Regulation, the Maltese Financial Supervision Authority has clarifed that there is no specific form to be submitted for this purpose. The MFSA stated:
βThe notification for the exemption for a market maker should be made in writing to the competent authority of its home member state, specifying that it intends to make use of the exemption (Refer to Article 17(5) of the EU Short Selling Regulation). There is no prescribed form of this notification.
The other public disclosure notifications should be made by email in the forms prescribed in the MFSA short selling guidance notes (Refer to: http://www.mfsa.com.mt/pages/viewcontent.aspx?id=336) and sent to the MFSA by way of an email to: Mr Nathan Fenech nfenech@mfsa.com.mt or Mr Edward Grech on egrech@mfsa.com.mt.β
