DESCRIPTION:The European Supervisory Authorities (ESAs) organise an online public hearing on Friday 11 February 2022\, from 09:30-16:30 CET to discuss the development of their draft Technical Advice to the European Commission regarding the PRIIPs Regulation. \nBackground information on the review of the PRIIPs Regulation \nThe review of the PRIIPs Regulation is part of the European Commission’s upcoming strategy for retail investments in Europe\, which aims to ensure that retail investors can take full advantage of capital markets and that rules are coherent across legal instruments. \nTaking into account Article 33 of the PRIIPs Regulation\, the European Commission asked the ESAs in a Call for Advice in July 2021 to provide advice on various elements of the PRIIPs Regulation and to deliver their advice by 30 April 2022. \nIn order to gather input and views of external stakeholders the ESAs launched a Call for Evidence between October and December 2021. In this call\, feedback was requested on the following topics: \nGeneral survey on the use of the KID\nGeneral survey on the operation of the comprehension alert\nSurvey on the practical application of the rules\nUse of digital media\nScope of the PRIIPs Regulation\nDifferentiation between different types of PRIIPs\nComplexity and readability of the KID\nPerformance scenarios and past performance\nPRIIPs offering a range of options for investment (Multi-Option Products (“MOPs”))\nAlignment between the information on costs in the PRIIPs KID and other disclosures\nWhat is on the agenda? \nDuring the public hearing the ESAs will present their preliminary views in relation to the feedback provided during the call for evidence and the areas to be addressed in the ESAs’ final advice. \nA draft agenda will be made available shortly. \nWho can attend? \nAny one interested in this topic can attend the public hearing. \nIt will be particularly of interest to financial market participants\, their representative associations\, investor representatives or consumer bodies\, and consultants or academics and representatives from the EU and national institutions. \n

SUMMARY:AIMA APAC Webinar: AIFMD Review and Its Impact on APAC Managers
DESCRIPTION:The European Commission published last week a proposal to amend the AIFMD and UCITS directives. There are a number of provisions that will impact third country managers that either market or manage funds in the EU or that are sub-delegates for EU AIFMs (access to member summary here). \nThe proposal changes the rules for private placement by introducing additional requirements on the domiciles of the funds or managers that place funds in EU member states. It is noteworthy that proposed amendments to the rules for third country funds marketed in the EU via private placements will require them not to be domiciled in a country listed on either the EU list on non-cooperative jurisdictions for tax purposes or the EU “high-risk” third country AML blacklist. \nThe Cayman Islands was until October 2020 on the Annex 1 tax haven blacklist. In October 2021\, while Australia was removed\, Hong Kong became a new addition to the Annex II tax haven grey list as\, following review\, its foreign source tax rules have been found non-compliant. Singapore’s rules are also under review and it too could be added to Annex II if there are defects to address. \nAdditionally\, the proposed rules will result in additional scrutiny on managers delegating outside the EU. \nThe panel will discuss the key potential ramifications for private fund managers in the APAC region.
